2. Statutory right of withdrawal for consumers

In distance contracts, consumers have the statutory right of withdrawal in accordance with the following notice.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

To exercise your right of withdrawal, you must inform us, 2Mountain-Development GmbH, Neualmerstrasse 37, 5400 Hallein, Austria, phone +43 800 7000 477, e-mail office@2mountain-development.com, of your decision to withdraw from this contract by means of an unambiguous statement. You may use the model withdrawal form at the end of this page, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of withdrawal

If you withdraw from this contract, we will reimburse to you all payments received from you, including delivery costs, without undue delay and no later than fourteen days from the day on which we receive your notification of withdrawal. This excludes additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us.

We will use the same means of payment for the reimbursement as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back, or until you have supplied evidence of having sent back the goods, whichever is earlier.

You must return or hand over the goods to us, or to a return address we provide, without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send back the goods before the fourteen-day period expires.

You bear the direct cost of returning the goods. As the GOOTER cannot normally be returned by regular post due to its nature, the direct return costs within the European Union are estimated at no more than approximately EUR 350.00 per device.

You only have to pay for any loss in value of the goods if this loss in value is due to handling that is not necessary to check the nature, characteristics and functioning of the goods.

3. Additional notes on practical handling

The following notes serve to ensure quick and reliable processing. They are not additional requirements for the validity of the withdrawal but are co-operation obligations in the interest of orderly handling.

3.1 Submitting the withdrawal declaration

For faster handling, we recommend sending the withdrawal by e-mail to office@2mountain-development.com and support@gooter-golf.com, including the following details:

Order number
Delivery address
Delivery date
Serial number of the device, if available
Phone number or e-mail address for queries

3.2 Photos and condition documentation

To document the return condition, we ask you to submit current photos of the product together with the withdrawal declaration, in particular of:

Overall view of the device
Tyres and underside
Handlebar and folding area
Battery, charger and accessories
Packaging condition
Visible soiling, scratches or signs of use

If no photos are provided, the condition and value-loss assessment will be based solely on the condition determined upon receipt of the goods.

3.3 Return and tracking number

The return shipment must be packaged safely for transport, complete and in a condition that allows damage-free transport.

Please send us the tracking number and shipping service provider after dispatch. Unpaid shipments may be rejected for organisational reasons.

3.4 Original packaging

The use of the original packaging is strongly recommended. A return without the original packaging does not render the withdrawal ineffective but may result in an additional loss in value if the goods can no longer be sold as new or only at a reduced price.

3.5 Return of the battery

Lithium batteries must be packaged and transported in a safety-relevant manner. Please observe the safety instructions provided and the applicable transport regulations for lithium batteries. Damaged, deformed, swollen, leaking or noticeably hot batteries may not be returned without prior coordination with us.

4. Loss in value on withdrawal – transparent reference values

Note

The table below contains non-binding reference values for assessing a loss in value. The actual condition of the returned goods upon receipt is always decisive. Several value-reducing circumstances may be considered cumulatively.

Assessment principles

Permissible inspection of the goods corresponds exclusively to handling that would also be possible in a brick-and-mortar shop.

Use outdoors, on golf courses or under real-world conditions generally exceeds mere inspection.

Even slight traces on tyres, underside, foot deck, frame, handlebars, plug connections or charging unit may indicate use beyond mere inspection.

The actual loss in value is assessed on a case-by-case basis, taking into account completeness, cleanliness, technical function, resaleability and safety condition.

5. Exclusion of a voluntary right of return

In addition to the statutory right of withdrawal there is no voluntary right of return or exchange going beyond this, unless we expressly agree otherwise in writing.

7. Electronic withdrawal function (withdrawal button)

You can also declare your withdrawal via our permanently available electronic withdrawal function. You will find the „Withdraw from contract“ button in the footer of every page of our online shop. On the form that opens there, you enter your name, order number and email address and submit the withdrawal using the „Confirm withdrawal“ button. After submitting your declaration, you will receive an automatic confirmation of receipt by email without undue delay.
