SHIPPING AND DELIVERY TERMS

1. Scope

These shipping and delivery terms apply in addition to our GTC for all orders placed via gooter-golf.com.

2. Shipping area

We deliver within the countries selectable at checkout. Whether delivery to a specific address or area is possible follows from the order process. Deliveries to island regions, remote areas or hard-to-access regions may be subject to special restrictions, surcharges or longer delivery times.

3. Shipping costs

3.1 The applicable shipping costs are shown at checkout before the order is placed.

3.2 Free shipping only applies if expressly stated in the specific order process. Otherwise, only the shipping costs displayed at checkout apply.

3.3 Additional costs arising from incorrect address information, non-acceptance, failed delivery, repeated delivery attempt, return transport, storage or special delivery from the customer's sphere may be charged to the extent permitted by law.

4. Shipping method

4.1 Shipping is carried out depending on product, availability, destination area and logistical necessity via parcel service, freight forwarder or another suitable transport service provider.

4.2 The GOOTER may be subject to special transport requirements due to size, weight, packaging dimensions and the lithium battery. This may affect the choice, lead time and delivery modalities of the transport service provider.

4.3 Unless expressly agreed otherwise, delivery is made to the delivery address provided by the customer. Delivery to parcel shops, pick-up points or other alternative delivery locations is at the discretion of the respective transport service provider and is not owed by us.

5. Delivery time and delivery window

5.1 The specific delivery period follows from the respective product page, the checkout and/or the order confirmation.

5.2 Unless a different delivery period is specified for a product, delivery is made without undue delay, at the latest within 30 days from conclusion of the contract.

5.3 If delivery windows, pre-order periods, batch or charge deliveries are specified on the product page or at checkout, this period is considered the agreed delivery period.

5.4 Unless a fixed date has been expressly confirmed in writing, delivery time indications do not constitute fixed dates.

6. Batch, pre-order and charge model

6.1 We reserve the right to deliver GOOTER products from stock, in pre-sale or as part of production and shipping charges, depending on the production and logistics situation.

6.2 If a product is offered as a pre-order, batch or charge product, the delivery period communicated in the shop or in the order confirmation is decisive.

6.3 Assignment to a charge or a delivery window may be adjusted for organisational, production-technical or logistical reasons, insofar as this is reasonable for the customer.

7. Delivery delays and extension of delivery times

7.1 Delivery times may be extended in particular due to:

production or quality controls,
delays at suppliers or pre-suppliers,
transport and logistics bottlenecks,
capacity problems with shipping service providers,
dangerous goods regulations or transport requirements for lithium batteries,
customs clearance or regulatory measures,
strike, force majeure, natural events or other unforeseeable events,
unusually high demand or sell-out,
subsequent change requests by the customer.

7.2 An extension of the expected delivery time within a reasonable scope does not in itself constitute an automatic reason for withdrawal. The statutory rights of consumers, in particular after setting a reasonable grace period, remain unaffected.

7.3 Insofar as we recognise that a delivery is significantly delayed, we will inform the customer wherever possible of the updated expected delivery period.

8. Partial deliveries

Partial deliveries are permissible to the extent they are reasonable for the customer. We bear additional shipping costs for reasonable partial deliveries unless otherwise expressly agreed.

9. Delivery and customer cooperation

9.1 The customer must ensure that the delivery address is correct, complete and deliverable and that delivery is possible during the usual delivery times.

9.2 The customer must reasonably support the transport service provider if queries arise regarding delivery, appointment scheduling or availability.

9.3 Section 377 UGB (Austrian Commercial Code) applies to entrepreneurs. Entrepreneurs must inspect the goods without undue delay after receipt and report recognisable defects or transport damage without undue delay.

9.4 Consumers are asked to note obvious transport damage with the carrier as soon as possible and to inform us promptly. Failure to do so has no impact on the statutory rights of the consumer.

10. Risk transfer

10.1 With regard to consumers, the risk of accidental loss or accidental deterioration of the goods passes only upon handover to the consumer or to a third party named by the consumer and different from the carrier.

10.2 With regard to entrepreneurs, the risk passes upon handover of the goods to the carrier, forwarder or other transport service provider.

10.3 If the customer commissions a carrier themselves without using a selection option suggested by us, the risk passes upon handover to that carrier insofar as this is provided by law.

11. Non-acceptance, return and re-shipping

11.1 If delivery is not made or not accepted in time for reasons attributable to the customer, we are entitled, to the extent permitted by law, to charge the resulting expense including return transport, storage, renewed shipping and reasonable handling costs.

11.2 Statutory rights of the customer to refuse acceptance for justified statutory reasons remain unaffected.

12. Self-delivery and unavailability

12.1 If we are not supplied despite a proper covering transaction and without fault on our part, or if the product is permanently unavailable after the conclusion of the contract, we may withdraw from the contract in whole or in part.

12.2 In that case we will inform the customer without undue delay and refund payments already made without undue delay.
